Clearly Financials Professional Corporation (“Clearly Financials,” “we,” “us,” or “our”) is committed to protecting the personal information of our clients and website visitors. This policy explains what personal information we collect, how we use and protect it, when it may be processed outside Canada, and how you can reach us with questions or requests.

We handle personal information in accordance with the Personal Information Protection Act (Alberta) (“PIPA”) and, where it applies, the Personal Information Protection and Electronic Documents Act (Canada) (“PIPEDA”).

1. Who this policy applies to

This policy applies to personal information we collect from our clients (and, where relevant, individuals connected to a client, such as directors, shareholders, or spouses whose information is needed for an engagement) and from visitors to our website at www.clearlyfinancials.ca.

2. What personal information we collect

Depending on your relationship with us, we may collect:

• Contact and identification information — name, business name, mailing and email addresses, and telephone numbers.

• Engagement information — financial records, accounting and tax information, corporate and personal tax details, and supporting documents you provide so we can perform bookkeeping, compilation, tax, and advisory services.

• Website and inquiry information — the message and contact details you submit through the contact form on our website, and technical information collected automatically when you visit our site (see Section 7).

 

For personal (T1) and corporate (T2) tax engagements, we may also ask you to submit information through a secure online form hosted by a third-party provider (JotForm), which processes that information on our behalf under its own security and privacy commitments.

We collect only the personal information reasonably required for the purposes described below.

3. How we use personal information

We use personal information to:

• provide accounting, tax, compilation, bookkeeping, and advisory services;

• communicate with you about your engagement and respond to your inquiries;

• administer our practice, including billing and collection;

• meet our professional, legal, and regulatory obligations; and

• understand and improve how our website is used.

4. Consent

We collect, use, and disclose personal information with your consent, which may be express or implied depending on the sensitivity of the information and the circumstances. You may withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice, by contacting our Privacy Officer (Section 13); withdrawing consent may affect our ability to provide services to you.

5. Service providers and processing outside Canada

We use third-party service providers to operate our practice, including website hosting, cloud hosting, practice-management, document-management, communication, online-form, bookkeeping, tax-preparation-support, and software providers. Some of these providers, and the personnel who support our engagements, are located outside Canada, including in the United States.

Personnel outside Canada. Some of our work is performed by our own full-time staff located in the Philippines, who work exclusively for Clearly Financials. They are not a third-party outsourcing agency. They are bound by written confidentiality agreements, work on firm-controlled devices and systems, and are given access to personal information only on a need-to-know basis to perform their duties. We remain accountable for their handling of your personal information.

Purposes for processing outside Canada. Personal information may be stored or processed outside Canada for purposes including email and communications, document management, cloud hosting and storage, bookkeeping and tax-preparation support, practice administration, technical support, data backup, and the operation of the software we use to deliver our services.

Foreign law. When personal information is stored or processed outside Canada, it may be subject to the laws of the jurisdiction in which it is held, including lawful access by the courts, law enforcement, and government authorities of that jurisdiction.

Accountability and safeguards. We remain accountable for personal information transferred to a service provider for processing. We use contractual and other measures intended to require our service providers to protect your personal information to a standard comparable to our own. However, information held outside Canada may be accessible to foreign authorities under the laws that apply there, and we cannot guarantee that such access will not occur.

You may obtain information about our policies and practices for the use of service providers outside Canada, and about how to contact the individual accountable for our handling of personal information, from our Privacy Officer (Section 13).

6. Use of artificial intelligence and automated tools

We may use third-party artificial intelligence and automated software tools to help us prepare, review, and deliver our work. Where we do:

• we use these tools under contractual terms that prohibit the provider from using your information to train its models, that restrict how long your information is retained, and that require appropriate security;

• your information may be stored or processed outside Canada, including in the United States, as described in Section 5; and

• any work product relating to a client file is reviewed by a CPA in Canada before it is used or relied upon.

7. Cookies and website analytics

Our website uses cookies and similar technologies to understand how visitors use the site and to support our marketing. We currently use:

• Google Analytics 4 — website analytics (how visitors find and use our site). You can opt out using Google’s browser add-on at https://tools.google.com/dlpage/gaoptout.

• Meta Pixel — advertising and remarketing. You can manage or opt out of interest-based advertising through your Meta ad-preferences settings and through your browser or device controls.

 

By continuing to use our website, you consent to the use of these technologies. You can opt out of each tool as described above, and you can also block or delete cookies through your browser settings; some features of the site may not function properly if you do.

Our website is hosted by Wix, which processes the messages you send through our contact form and the technical information collected on the site on our behalf, under its own security and privacy commitments.

 

8. How we protect personal information

We maintain contractual, administrative, technical, and organizational safeguards appropriate to the sensitivity of the information, including multi-factor authentication, conditional access controls, device security, restrictions on who may access information, limits on how information is shared, and secure retention and disposal practices. Access by our personnel and service providers is limited to what is needed to perform their duties.

 

9. Retention

We retain personal information for as long as necessary to fulfil the purposes for which it was collected and to meet our professional, legal, and regulatory obligations, after which it is securely destroyed or de-identified. Working papers and files we create during an engagement remain our property and are retained in accordance with our policies and applicable professional standards.

 

10. Your rights: access and correction

You have the right to ask what personal information we hold about you, to request access to it, and to request correction of inaccurate or incomplete information, subject to the limited exceptions permitted by law. To make a request, contact our Privacy Officer (Section 13). We will respond within the time required by applicable privacy legislation.

11. Professional regulatory oversight

As a professional corporation registered with CPA Alberta, our client files and practices are subject to periodic review and inspection by CPA Alberta and its representatives for the purpose of regulatory oversight of the profession. Reviewers are themselves bound by confidentiality obligations.

12. Privacy breaches

If a breach involving your personal information occurs and creates a real risk of significant harm to you, we will notify you and the Office of the Information and Privacy Commissioner of Alberta, and take the steps required by PIPA.
